Terms & Conditions

These terms and conditions (“T&Cs”) apply to your access to, and use of the Application (defined hereinbelow). The Application is operated by Malta Taxi and its subsidiaries, associates, licensees, and affiliated companies (“Malta Taxi”).

You acknowledge that Malta Taxi is providing you with a revocabale license to use limited features of the Application and is not selling the Application or any features or technologies contained therein. 
By continuing usage of the Application, you are consenting to be bound by these T&Cs. Please ensure that you read and understand all these T&Cs before your use the application and features contained therein. If you fnd and of the T&Cs unacceptable, do not tender your acceptance to use the Application of avail to any of its features. 
Your agreement to these T&Cs shall operate as a binding and legally enforceable agreement between you and Malta Taxi in respect of the features offered/availed using the mobile application. 
I. Definitions 
All of the defined and capitalized terms in these T&Cs will have the meaning assigned to them here below: 

  • “Account” refers to the Rider’s account on the mobile application Malta Taxi enabling the use of the Application by the Rider 

  • “Application” shall mean the mobile application “Malta Taxi” and shall mean and include any updates provided by Malta Taxi from time to time. 

  •  “Registration Data” shall mean and may include the present, valid, true and accurate name, Email ID, age and such other information as may be required by Malta Taxi from time to time, provided by the Riders at the time of registration on the mobile application Malta Taxi or otherwise. 

  • “Rider” shall mean persons who have created an Account and use the Application. 

  • "You", “Your" or “Yourself” shall mean reference to the Rider accessing the Application. 

  • “Services” shall mean any transport services that are rendered or made available via the Application. 

2. Payment 
You understand that use of the Services may result in charges to you for the services or goods you receive ("Charges"). Malta Taxi will enable your payment of the applicable Charges for services or goods obtained through your use of the Services. Charges will include applicable taxes where required by law. Charges may include other applicable fees, product return fees, cancellation fees, estimated or actual tolls, and/or surcharges. Further, you acknowledge and agree that Charges applicable in certain geographical areas may increase substantially during times of high demand or due to other marketplace factors. 
All Charges and payments will be enabled by Malta Taxi using the preferred payment method designated in your Account, after which you will receive a receipt. If your primary Account payment method is determined to be expired, invalid or otherwise not able to be charged, you agree that Malta Taxi may use a secondary payment method in your Account, if available. Charges paid by you are final and non-refundable, unless otherwise determined by Malta Taxi. 
As between you and Malta Taxi, Malta Taxi reserves the right to establish or adjust Charges for any or all services or goods obtained through the use of the Services at any time. Malta Taxi will use reasonable efforts to inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your Account regardless of your awareness of such Charges or the amounts thereof. Certain users may from time to time receive promotional offers and discounts that may result in different amounts charged for the same or similar services or goods obtained through the use of the Services, and you agree that such promotional offers and discounts, unless also made available to you, shall have no bearing on your use of the Services or the Charges applied to you. Promotional offers and discounts are subject to change or withdrawal at any time and without notice. You may elect to cancel your request for Services at any time prior to the commencement of such Services, in which case you may be charged a cancellation fee on a Third Party Provider’s behalf. 
With respect to Third Party Providers, Charges you incur will be owed directly to Third Party Providers, and Malta Taxi will collect payment of those charges from you, on the Third Party Provider’s behalf as their limited payment collection agent, and payment of the Charges shall be considered the same as payment made directly by you to the Third Party Provider. In such cases, you retain the right to request lower Charges from a Third Party Provider for services or goods received by you from such Third Party Provider at the time you receive such services or goods, and Charges you incur will be owed to the Third Party Provider. Malta Taxi will consider in good faith any request from a Third Party Provider to modify the Charges for a particular service or good. This payment structure is intended to fully compensate a Third Party Provider, if applicable, for the services or goods obtained in connection with your use of the Services. Except for amounts provided by you through the Application as part of the “tip” feature, Malta Taxi does not designate any portion of your payment as a tip or gratuity to a Third Party Provider. You understand and agree that, while you are free to provide additional payment as a gratuity to any Third Party Provider who provides you with services or goods obtained through the Service, you are under no obligation to do so. There also may be certain Charges you incur that will be owed and paid directly to Malta Taxi or its affiliates.

If you think a correction should be made to any Charge you incurred, you must let Malta Taxi know in writing within 30 days after the Charge took place or Malta Taxi will have no further responsibility and you waive your right to later dispute the amounts charged.

3. Damage, Cleaning, Lost and Found, and Violation of Terms.

Malta Taxi may charge you a fee if, during your use of the Services, you have caused damage to a vehicle or property that requires repair or cleaning. The amount of such fee shall be determined, in Malta Taxi’s sole discretion, based on the type of damage and the severity.

4. Refund Policy

We hope that every trip you book through the Malta Taxi app goes without issue but we understand that sometimes things happen. If a trip you take does not meet your expectations, you can share your feedback by rating your driver in the app; and if you believe there was an error with your price or a more serious issue occurred on your trip, you can report it to our support team. In some cases, your report may be covered by our Rider Refund Policy.

We want you to know what to expect when you report issues, so we are sharing examples of when you may be eligible to receive a full or partial refund of the price you paid. If you have an issue on a trip, let us know within 30 days. All requests will be evaluated at Malta Taxi’s sole discretion, and on a case-by-case basis.

When are you may be eligible to receive a full or partial refund include:

  • A fare or fee was charged in error or your trip experienced a technical issue, like an eligible promotion not applying correctly.
  • Your trip price was significantly higher than the estimate you were shown in the app prior to booking, and it was not due to added stops, or a changed destination.
  • Your trip was not completed within a reasonable walking distance to your requested destination.
  • You or the intended rider did not take the trip or there are other fraud concerns.

When am I not eligible to receive a full or partial refund?

  • An issue related to the vehicle quality or the type of vehicle dispatched for your trip.
  • An issue with a driver not meeting your quality expectations.
  • An issue that was caused by user error, like requesting the wrong type of vehicle
  • An on-trip delay or on-trip routing issue due to uncontrollable events (e.g. traffic, construction) or a change in price due to adding or removing stops or updating your intended destination after your trip began
You can submit a request for a refund or a general complaint about your ride to Malta Taxi customer service team at maltataxi.mt or in the app within 30 days of encountering an issue. If we determine you are eligible, you should expect any refunds to be returned to your original payment method within 3-5 business days, depending on your bank.

Providing inaccurate information about your trip experience when disputing fees or charges violates our T&C’s and may result in your request being denied and/or your account being deactivated.
